Ashley St. Clair Files Paternity Lawsuit Against Elon Musk, Seeks Sole Custody of Newborn
Ashley St. Clair has filed a paternity suit against Elon Musk, also requesting sole legal custody of her newborn son, according to court documents obtained by Page Six.
The 26-year-old claims in the lawsuit that she began dating the 53-year-old SpaceX CEO in May 2023. She alleges they had sex around January 2 and January 3, 2024, which she believes led to her pregnancy. While her son’s name and birth date were redacted in the documents, his first initial is “R.”
St. Clair insists she is certain Musk is the father, stating in her filing that she “did not have sexual intercourse with any other male during the time the child was conceived.” She has asked the court to order Musk to take a DNA test to confirm paternity.
Musk’s representatives declined to comment when contacted by Page Six.
Alleged Text Messages from Musk
St. Clair submitted text messages as evidence of her relationship with Musk, including messages where he allegedly acknowledged the child as his.
According to the filing, after she sent Musk a hospital photo of herself holding the baby, he allegedly responded, “I look forward to seeing you and him this weekend.”
She also claims that on November 24, 2024, Musk texted her, “I want to knock you up again,” and as recently as February 2, he reportedly messaged, “Well, we do have a legion of kids to make.”
Earlier this week, screenshots of their flirtatious online exchanges resurfaced, showing messages that seemed to reference different sexual positions.
Seeking Custody, Not Child Support
While St. Clair is not currently asking for child support, she has requested a temporary order of financial support for the baby.
In her filing, the conservative activist argues that she should have sole legal custody, stating, “I am the only parent to make decisions for R.S.C. I schedule and take him to all his medical appointments.”
“I am the only parent who cares for him on a daily basis. I feed him, bathe him, and ensure that all his physical and emotional needs are met,” she continued.
St. Clair alleges Musk was absent for the birth, despite having the opportunity to be there, and that he has shown little interest in having custody. She also claims he has only met their son three times: once for two hours in New York on September 21, 2021, again for one hour the next day, and finally for 30 minutes in Austin, Texas, on November 30, 2024.
“[Musk] has never asked to see our child on any other occasion, he has never communicated with me about our child without my prompting, he has never asked for photos of our child or checked in after doctor’s appointments,” she stated in the filing.
St. Clair’s Public Announcement
Earlier this month, St. Clair publicly revealed on X (formerly Twitter) that she had a baby with Musk.
“Five months ago, I welcomed a new baby into the world. Elon Musk is the father,” she wrote on February 14.
“I have not previously disclosed this to protect our child’s privacy and safety, but in recent days it has become clear that tabloid media intends to do so, regardless of the harm it will cause.”
She claims she tried to handle the situation privately to keep it from becoming public.
Musk’s Daughter Responds
Musk, who would now have 13 children if the paternity claim is confirmed, has not publicly commented on the lawsuit. However, his estranged 21-year-old daughter, Vivian Wilson, weighed in on the situation.
“Wow, if I had a nickel for every time I found out I had half-siblings through Reddit, I’d have two nickels… which isn’t a lot, but it’s weird that it’s happened twice, right?” she posted on TikTok.
Grimes Accuses Musk of Neglecting Their Child’s Medical Needs
In addition to the lawsuit with St. Clair, Musk is also embroiled in a custody battle with ex-girlfriend Grimes over their three children: X Æ A-Xii (4), Exa Dark Sideræl (3), and Techno Mechanicus (2).
On Thursday, the 36-year-old Canadian musician accused Musk of ignoring her while one of their children faced a medical emergency.
“I’m not giving any details, but he won’t respond to texts, calls, or emails and has skipped every meeting,” she wrote on X.
“Our child will suffer lifelong impairment if he doesn’t respond ASAP, so I need him to f–king respond, and if I have to apply public pressure, then I guess that’s where we are at.”
